New link embedded--Language Amendment to Regulations Governing the Licensure of Clinical Nurse Specialist

A review of the wording in the regulations governing the practice of Advanced Practice Registered Nurses and the Code of Virginia revealed dissymmetry in the language of the two documents. Therefore, a Notice of Intended Regulatory Action (NOIRA) was submitted to the Board of Nursing and Medicine to amend the language of the regulation "18VAC90-30-125".  The Code is the primary regulatory document for our practice.  On the right is the website for the VA Town Hall, where anyone can post a comment in support or opposition to amending "18VAC90-30-125".   When you right-click on the picture on the website, you will be taken to the Town Hall website.  Or use this link:

The comment period will begin on 12/2/2024 and will end on 1/16/2025. 

Please post a comment in support of amending "18VAC90-30-125."

  • Virginia Code § 54.1-2957. Licensure and practice of advanced practice registered nurses states, "J. A clinical nurse specialist licensed by the Boards of Medicine and Nursing who does not prescribe controlled substances or devices may practice in the practice category in which he is certified and licensed without a written or electronic practice agreement."

  • However, the Regulations Governing the Licensure of APRNs dated 11/8/23 states "18VAC90-30-125". Practice of advanced practice registered nurses licensed as clinical nurse specialists. "I. Advanced practice registered nurses licensed in the category of clinical nurse specialist shall practice in consultation with a licensed physician in accordance with a practice agreement between the advanced practice registered nurse and the licensed physician".

Board Action

 

The Boards of Nursing and Medicine have amended 18VAC90-30-125 to reflect changes to practice agreement requirements for clinical nurse specialists made by Chapter 197 of the 2022 Acts of Assembly.
